广西壮族自治区人民政府办公厅关于印发2008年广西壮族自治区支持四川省抗震救灾款物管理办法的通知

各市、县人民政府，自治区农垦局，自治区人民政府各组成部门、各直属机构：

　　《2008年广西壮族自治区支持四川省抗震救灾款物管理办法》已经自治区人民政府同意，现印发给你们，请认真贯彻执行。

2008年广西壮族自治区支持四川省
抗震救灾款物管理办法




　　第一条 为贯彻落实中纪委、监察部、民政部、财政部、审计署联合印发的《关于加强对抗震救灾资金物资监管的通知》（中纪发〔2008〕12号）精神，切实加强对抗震救灾资金和物资的管理，规范救灾资金和物资的拨付和使用，发挥救灾资金和物资的最大效益，根据有关财政法规，制定本办法。

　　第二条 本办法所称抗震救灾款物，是指在广西壮族自治区境内开展社会捐助活动取得的社会捐助资金和物资，以及财政安排、各有关部门筹集用于支援四川省抗震救灾的各项资金和各类物资。


　　第三条 抗震救灾资金包括以下渠道筹集的资金。

　　（一）财政安排的专项救灾资金；

　　（二）广西壮族自治区社会捐助接收工作站和广西壮族自治区慈善总会接收到的社会各界捐赠资金；

　　（三）广西壮族自治区红十字会接收到的社会各界捐赠资金；

　　（四）自治区救灾专户的利息收入；

　　（五）其他渠道筹集的用于救灾的资金。

　　第四条 各市、县（市、区）捐助工作站或慈善总会和红十字会要及时把接受社会各界捐助的抗震救灾资金统一汇到广西壮族自治区捐助工作站或自治区慈善总会和自治区红十字会指定的账户。


　　第五条 抗震救灾物资包括以下几方面筹集的实物。

　　（一）自治区人民政府统一调配给灾区的各类救灾物资；

　　（二）有关部门专项采购用于灾区救灾的各类物资；

　　（三）社会各界捐助给灾区的救灾物资。


　　第六条 抗震救灾资金和物资的使用范围。

　　（一）解决灾民衣、食、住、医等生活困难；

　　（二）紧急抢救、转移和安置灾民；

　　（三）灾民倒塌房屋的恢复重建；

　　（四）灾后生产的恢复重建；

　　（五）捐赠人指定的与救灾直接相关的用途。


　　第七条 资金的管理。

　　（一）社会捐助的抗震救灾资金纳入特设的抗震救灾财政专户（以下简称“财政专户），实行收支两条线管理，专款专用，任何部门、单位和个人均不得挤占、挪用和贪污。

　　（二）自治区财政厅在国有商业银行开设抗震救灾财政专户，用于接收自治区捐助工作站、自治区慈善总会和自治区红十字会接收到的抗震救灾捐款及其收入户暂存的利息收入和其他收入，该账户资金形成的利息收入以及支出户转入的利息收入，并按规定拨付经批准动用的抗震救灾资金；根据自治区民政厅和红十字会申报的用款计划，向自治区民政厅和红十字会支出户拨付抗震救灾资金。

　　（三）自治区民政厅和红十字会商自治区财政厅在国有商业银行开设抗震救灾资金收入账户，用于暂存社会各界捐助的款项、账户的利息收入以及其他收入。收入账户除了向财政专户划转捐助资金外，不得发生其他支出业务，月末无余额。

　　（四）自治区民政厅和红十字会商自治区财政厅在国有商业银行开设抗震救灾资金支出账户，用于接收财政专户拨入的抗震救灾资金和暂存账户的利息收入。支出户除接收财政专户拨入的资金及该账户的利息收入外，不得发生其他收入业务。

　　（五）收入户和支出户的利息收入按季度缴入财政专户，并应与捐助收入及其他收入分开缴入。财政专户发生的利息收入直接计入财政专户。

　　（六）自治区捐助工作站、自治区慈善总会和自治区红十字会收到社会捐助的各项救灾资金，要及时汇缴财政专户,不得“坐收坐支”。

　　（七）自治区民政厅和自治区红十字会根据抗震救灾需要和自治区人民政府的审批文件，向自治区财政厅提出用款申请，自治区财政厅根据申请及时将资金拨付到救灾资金支出账户。


　　第八条 资金分配及审批。

　　（一）财政安排的抗震救灾专项资金。

　　自治区本级财政安排的对口支援抗震救灾资金按相关审批程序办理资金拨付。

　　（二）社会捐助的抗震救灾资金。

　　1.分配基本原则：统一管理，统筹安排。

　　2.分配方案的提出：自治区民政厅和自治区红十字会根据四川省抗震救灾进度及我区捐助资金落实情况提出资金分配方案商自治区财政厅后报自治区人民政府审定。

　　3.资金审批权限。

　　（1）总额在500万元以下（含500万元）的，由自治区分管救灾工作的副主席审批；

　　（2）总额在500万元及以上、1000万元以下（含1000万元）的，由自治区分管救灾工作的副主席审核后，送自治区分管财政的副主席审批；

　　（3）总额在1000万元及以上的，由自治区分管救灾工作的副主席和分管财政的副主席审核后，报自治区主席审批。

　　（三）抗震救灾资金经自治区人民政府审批后2个工作日内拨付到位。


　　第九条 物资的管理。

　　（一）社会各界捐助的救灾物资由捐赠单位或捐赠接受单位组织运往四川省灾区，有关捐赠情况要及时报送当地民政部门并逐级上报自治区民政厅。

　　（二）使用抗震救灾采购货物、工程和服务行为，要严格执行《中华人民共和国政府采购法》和有关规定。


　　第十条 监督管理。

　　（一）各部门要对抗震救灾款物实行专账核算，不得截留、挪用和擅自改变用途，必须专款专用。

　　（二）自治区财政、民政和红十字会应定期向社会公布救灾资金和物资的筹集及使用情况，接受审计、监察部门、社会各界和媒体的监督。

　　（三）审计、监察部门应将抗震救灾资金和物资的使用情况列入重点专项审计和监察计划，对救灾款物从筹集、管理、使用的各个环节进行审计和监察。

　　（四）自治区民政厅应建立健全报表统计制度，对救灾物资的接收、调配情况，在上报自治区人民政府的同时，抄送自治区财政厅。

　　（五）自治区民政厅、财政厅、自治区红十字会等有关部门应对抗震救灾使用和相关项目建设情况进行跟踪检查，发现问题及时予以纠正，并报告自治区人民政府。

　　第十一条 社会捐助的资金和物资，如捐助者有明确意愿（符合国家规定使用范围的）的，应按照捐助者的意愿安排使用；没有明确意愿的，由政府统筹安排使用。

　　第十二条 本办法自印发之日起施行。
